Terms of Sales
1. General information
These general conditions of sale define the contractual relationship between 33 mai par Fanny Sigel and any natural or legal person (hereinafter the "Customer") visiting or making a purchase on www.33mai.fr (hereinafter the "Site") for itself or for a third party.
Any Customer can read the general conditions of sale on the website. Consequently, any order entails your full and complete adherence without exception or reservation to the conditions set out in this contract.
33 mai reserves the right to modify, at any time, the content and form of these general conditions of sale. These are authentic and apply to the exclusion of all other conditions or agreements.
2. Products
The photos and product descriptions are given for information only, the representation made by the customer of the product may potentially differ from reality.
The products and prices presented on the website are only valid within the limits of available stocks and do not give rise to any compensation in the event of a shortage.
The images and/or photographs illustrating the products offered on the Facebook page, Instagram and on the website do not enter into the contractual field nor those found on any other medium. The products are handmade and may differ slightly from each other. 33 mai is committed to representing the products as well as possible, but it is possible that depending on the color settings made on the customer's screen or during the shooting, the colors of the products differ from the actual products. On the other hand, 33 mai cannot be held responsible for the possible blackening and/or alteration of a piece of jewellery.
3. Availability of products
All creations are made to order and handmade in France.
In case of unavailability of a product after validation of your order, we undertake to contact you within 7 days and to tell you if this product will be available soon or permanently out of stock. In this case, the refund will be made with the same payment method as your order.
After placing an order, 33 mai will acknowledge receipt by sending you an order confirmation email including the summary of your order and its number.
4. Order
The customer cannot complete or cancel an order once it has been placed. No refund is made to the customer. 33 mai undertakes to sell the products on this website within the limit of the stock of raw materials available.
33 mai reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. In the event of an error in the wording of the recipient's contact details, 33 mai cannot be held responsible for the impossibility in which it could be to deliver the product(s) ordered.
33 mai reserves the right to refuse or cancel the delivery, at its discretion, of any order placed on this website as long as payment has not been settled.
5. Price
All our prices are expressed in Euros (€).
The prices payable for the products are those displayed on this site on the date of the order, excluding delivery costs. Delivery costs are invoiced in addition to the products ordered. These are visible at the time of the shopping cart summary. 33 mai reserves the right to modify the prices and other fees mentioned on this site at any time. In the event of a price error on a product, 33 mai reserves the right to modify this price by offering the customer the choice of canceling his order if the new price does not suit him.
The price charged to the customer is the price indicated on the order confirmation on which the shipping costs and any discounts are displayed. Prices are exclusive of VAT. VAT is not charged to you. For orders outside France and outside the European Union, VAT may be applied during customs clearance.
6. Payment
All payments are made using a credit card. In accordance with the regulations in force, and to ensure the security and confidentiality of their information, 33 mai does not memorize the bank details of its customers.
7. Shipping and Delivery
Orders are processed within 5 to 10 working days, upon receipt of payment, and sent by post.
33 mai cannot be held responsible for delays, damage and losses due to the carrier.
No refund is therefore possible.
The products are delivered to the delivery address that you indicated to us during the ordering process.
8. Returns and Exchanges
It is the customer's responsibility to check the quantity and condition of the goods as soon as the products have been delivered to him, the customer must announce himself and inform within seven days (the postmark being proof) in writing ( registered or email) to the seller at the address appearing on the general conditions of sale.
Returns are accepted only with original and new packaging, suitable for their remarketing, the customer can request an exchange and this without any costs, with the exception of the return costs.
In accordance with the law, the customer has a right of withdrawal of 14 days to return the products, in accordance with the provisions of articles L 121-16 and following of the consumer code.
This period runs from the receipt of the goods.
Personalized items are neither exchangeable nor refundable.
The return must be sent with a tracking number in order to follow the traceability of the package and accompanied by proof of order to the address appearing in the conditions of sale.
9. Force majeure
33 mai will make every effort to fulfill its obligations but will in no way be held responsible for cases relating to force majeure or fortuitous events. Thus, any delays or absence of delivery resulting from circumstances beyond its control, in particular in the event of strikes, wars, natural disasters or any other circumstances which prevent the smooth running of the production, transport or delivery of products cannot be charged to the seller. In addition to the cases usually retained by case law, are expressly established as force majeure or fortuitous events the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning; the shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers. In case of delay 33 mai will fulfill its obligations as soon as possible and reserves the right to distribute the stocks of remaining products among its customers in an equitable manner.
10. Personal data
33 mai undertakes to respect the confidentiality of personal data mentioned by customers when ordering on this website and to process them within the limits imposed by law. The data may be used by the internal service of 33 mai in order to improve our products and services. However, the customer is entitled to refuse the sending of invitation emails or commercial communication when registering. This possibility remains in force at all times. The customer undertakes to inform his personal data in a necessary way in order to ensure the smooth running of his order (invoicing and delivery). He undertakes that these are correct and up to date at the time of the order. 33 mai transmits personal data to third parties only insofar as they are essential for the proper execution of the order. No data will be transmitted to third parties for commercial purposes.
11. Intellectual Property
All the elements, articles, brands, models, drawings… appearing on the website, the social networks of 33 mai are the exclusive property of the brand 33 mai and have been filed with the INPI. Any reproduction is strictly prohibited and may be penalized under Intellectual Property.
As well as the photos which are the exclusive property of the brand.
Consequently, none of this information may be reproduced, modified, redistributed, translated, commercially exploited or reused in any way whatsoever without the prior written consent of 33 mai.
12. Liability
These "General Conditions of Sale" determine all of our obligations and responsibilities. We are not bound by any other warranties, conditions or other provisions, except those expressly mentioned in the Terms of Sales. The provisions of these general conditions of sale cannot deprive the buyer of the legal guarantee which obliges the seller to guarantee him against all the consequences of hidden defects of the thing sold.
13. Partial non-validation
If one or more stipulations of these general conditions are recognized as invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations retain all their force. and their scope.
14. Applicable law
These general conditions of sale as well as all sales where they are applicable are subject to French law.
